I am writing to provide guidance to constituent institutions regarding staff employees who have been unable to work on-site or to telework, who have exhausted all personal leave, and who are in a leave without pay (LWOP) status due to the COVID-19 event. This applies in particular to individuals who disclose an inability to report for on-site work due to personal circumstances and/or due to the nature of their job are unable to telework.
As we are soon to approach the one-year mark for the COVID-19 event, we have received inquiries from several constituent institutions about the continued status of these individuals and their LWOP status, and the need to have these positions re-filled based on operational need.
It remains our goal to be maximally supportive of employees impacted by the COVID-19 event and to minimize furloughs, reductions in force, and separations to the greatest extent possible. To this end, the University's efforts to date have included special paid administrative leave, interchangeable use of personal leave, advancement of leave accruals, make-up leave provisions, alternative work assignments as feasible, teleworking and flexible schedules, and COVID-19 leave banks. However, we recognize that there are some employees who are no longer able to be accommodated through these various measures and by necessity were transitioned by the institution to LWOP status.
While we encourage constituent institutions to continue to take all available steps to minimize adverse impacts to employees affected by COVID-19, we also understand that there may be necessity to separate from employment some employees who have been in extended LWOP status. For this reason, constituent institution Chief Human Resources Officers are authorized, in consultation with their management, to implement such separations in accordance with relevant University policies when deemed necessary and absent any remaining reasonable alternatives. Such employees must be separated from employment in adherence with the following policies:
* For SHRA employees, such action is governed by the "separation due to unavailability" section of the State's Separations policy<https://myapps.northcarolina.edu/hr/download/106/onboarding-separations/401…> and its defined employee notification requirements.
* For EHRA non-faculty employees, such action is governed by the policy and procedure defined by Sections 300.1.1<https://www.northcarolina.edu/apps/policy/index.php?section=300.1.1> and 300.2.1<https://www.northcarolina.edu/apps/policy/index.php?section=300.2.1> of the UNC Policy Manual.
All such decisions should be reached after careful consideration of all other available options and that takes into account any relevant equal opportunity considerations. Likewise, in the event of separations, care shall be given to documenting the separation in a manner that makes clear that it was not due to deficient performance or misconduct in any manner. Further, if the opportunity exists to re-employ such an impacted individual within 12 months of separation, this should be given all due consideration including a waiver of recruitment in accord with your institutional procedures.
This memorandum is intended to address impacted SHRA and EHRA Non-Faculty staff employees only. Any potential separation of faculty related to COVID-19 impacts is a separate matter and would be subject to the institution's relevant faculty policies in consultation with your provost and legal counsel.
Institutions must report any separations related to COVID-19 and a mechanism to do so will be added to the existing COVID tracking report that institutions provide to UNC System Human Resources each month.

Dear Chancellors:
As discussed during our call this morning, NC DHHS has announced updated COVID vaccine prioritization. The new priority categories (now referred to as “groups” instead of “phases) as described on the DHHS COVID vaccine website<https://covid19.ncdhhs.gov/vaccines> are:
Group 1: Health care workers & Long-Term Care staff and residents (active group)
* Health care workers with in-person patient contact
* Long-term care staff and residents—people in skilled nursing facilities, adult care homes and continuing care retirement communities
Group 2: Older adults (active group)
* Anyone 65 years or older, regardless of health status or living situation.
Group 3: Frontline essential workers
* The CDC defines frontline essential workers as workers who are in sectors essential to the functioning of society and who are at substantially higher risk for exposure to COVID-19.
Group 4: Adults at high risk for exposure and increased risk of severe illness
* Anyone 16-64 years old with high-risk medical conditions that increase risk of severe disease from COVID-19 such as cancer, COPD, serious heart conditions, sickle cell disease, Type 2 diabetes, among others, regardless of living situation.
* Anyone who is incarcerated or living in other close group living settings who is not already vaccinated due to age, medical condition or job function.
* Essential workers not yet vaccinated. The CDC defines these as workers in transportation and logistics, water and wastewater, food service, shelter and housing (e.g., construction), finance (e.g., bank tellers), information technology and communications, energy, legal, media, public safety (e.g., engineers) and public health workers.
*
Group 5: Everyone who wants a safe and effective COVID-19 vaccination.
We have not yet received additional guidance from DHHS. When we do, we will share it with you. Based on conversations with DHHS and Secretary Cohen’s remarks during this afternoon’s press conference, I can offer the following:
1. University faculty and staff. There is no separate group or category for education workers. Instead, UNC faculty and staff are eligible for the vaccine based on the Group that applies to that individual. For example:
* A faculty member age 65 or older falls under Group 2 and is eligible for the vaccination now.
* A staff member who meets the definition of a “frontline essential worker” is eligible under Group 3 (A frontline essential worker is one who “is in a sector essential to the functioning of society and is at substantially higher risk for exposure to COVID-19.” I do not have any more information at this time on the definition of a frontline essential worker).
1. Students. There is no longer a separate category prioritizing students (recall students were previously in “Phase 3” ahead of “Phase 4”). Now, students become eligible for the vaccine based on the Group into which an individual student falls. For example:
* A student who is age 65 is eligible under Group 2.
* A student who does not fall into any other Group would be eligible under Group 5.
Note on students: I do not know if “living in other close group living settings” under Group 4 applies to student housing and will seek further guidance from DHHS.
As we receive more information, we will share it with you.

Subject: Current Modified Stay-At-Home Order Extended for 3 Weeks
Hi Chiefs:
During his press conference this afternoon, Governor Cooper announced the extension of the current Modified Stay-At-Home Order for another three weeks. Executive Order 188<https://files.nc.gov/governor/documents/files/EO188-Extension-of-Modified-S…> goes into effect this Friday (when the current EO expires) and remains in effect until 5:00pm on Friday, January 29th. All restrictions under the existing executive order (EO 181) are extended for this three-week period; no new restrictions are imposed. A copy of EO 188 is attached.
As a reminder, a summary of the restrictions imposed under EO 181 that are now extended through the end of this month is listed below:
* Stay at Home for High-Risk Individuals: High-risk individuals (those over age 65 or any person with serious underlying medical conditions) are strongly encouraged to stay at home and travel only for essential purposes.
* Business Nighttime Closure: Certain categories of businesses and facilities must close from 10:00pm to 5:00am (nighttime closure requirement). The nighttime closure requirement applies to:
* Amusement Parks
* Bars, nightspots, and indoor arenas
* Fitness facilities
* Movie theaters, meeting spaces, and entertainment facilities
* Museums and aquariums
* Parks
* Personal care and grooming businesses
* Pools
* Restaurants
* Retail businesses
* Exemptions from the nighttime closure requirement include retail businesses that sell groceries, health care supplies, and fuels. Restaurants may remain open past 10:00pm for take-out and delivery service only.
* Alcohol Sales: Alcohol sales for on-site consumption are prohibited from 9:00pm to 7:00am.
* Nighttime Events: Events or convenings outside the home must end by 10:00pm and all guests must leave and travel home. Professional and collegiate sports events may continue past 10:00pm.
* Nighttime Travel Restrictions (“Curfew”): Except for limited exceptions, a statewide curfew is imposed from 10:00pm to 5:00am (exceptions to the curfew include: professional and collegiate sports events, religious services, law enforcement and other first responders, travel for required work, obtaining groceries, medical care, fuel, health care supplies, and taking care of a family member, friend, or pet).
* Mandatory Face Coverings:
* Face coverings required in all public indoor settings if there are nonhousehold members present, regardless of the individual’s ability to maintain social distance. Face coverings required in public outdoor settings if individuals are unable to maintain six feet of social distance from non-household members (the application of the mandatory face covering requirement to collegiate athletes remains the same – wearing face coverings is encouraged but not required when collegiate athletes are strenuously exercising or recovering from exercise and athletes are participating in a sport that is under conference oversight requiring COVID-19 risk reduction protocols).
* Good faith effort on the part of employers to provide face coverings to employees.
* Occupancy Limits:
* Occupancy limits on indoor stadiums, arenas, and other similar venues remain the same (25 guest limit; the previous guidance from DHHS permitting up to 2 parents/family members per student athlete participating in the sport in addition to the 25-guest limit – up to a total of 350 spectators – remains the same).
* Occupancy limits on very large outdoor facilities remains the same.
* Occupancy limits on other categories of business and retail establishments remain the same.
* Mass Gathering Restrictions: Mass gathering restriction remains the same (10 people indoors and 50 people outdoors) – the exception for educational institutions and governmental operations remains the same, as do the occupancy limits for indoor stadiums and very large outdoor facilities.
In addition, Secretary Cohen has issued a secretarial directive advising of immediate actions individuals should take to protect themselves and others (note that a secretarial directive is advisory; it is not enforceable through criminal sanctions as are violations of a gubernatorial Executive Order):
